This Acceptable Use Policy (“AUP”) applies to all use of MaxBackups, provided by Server Host Inc., located at 1309 STE1200, Coffeen Avenue, Sheridan, WY 82801, USA. Capitalised terms not defined here have the meanings assigned in the Terms of Service. Customer is responsible for its users, devices, data, and anyone using its credentials.
1. Lawful use
Customer may use the Service only for lawful file-level backup and restore of data it owns or is authorised to process. Customer shall comply with applicable privacy, data-protection, intellectual-property, employment, export-control, sanctions, and computer-misuse laws.
2. Prohibited content
Customer shall not knowingly store, transmit, restore, or facilitate:
- child sexual abuse material or content exploiting minors;
- malware, ransomware, destructive code, stolen credentials, or tools primarily intended for unauthorised intrusion;
- content that infringes copyright, trademark, privacy, confidentiality, or other proprietary rights;
- content used to commit fraud, phishing, identity theft, harassment, credible threats, or unlawful discrimination; or
- material whose possession, processing, or transfer is unlawful in an applicable jurisdiction.
3. Prohibited conduct
Customer shall not:
- probe, scan, test, bypass, disable, or interfere with Service security or access controls without prior written authorisation;
- access another customer’s account, device, repository, or data;
- extract, expose, share, or misuse service credentials or encryption material;
- introduce malicious code, launch denial-of-service activity, or use the Service to command or support a botnet;
- misrepresent identity, impersonate another person, evade enforcement, or create accounts through automated or fraudulent means;
- resell, sublicense, timeshare, or provide the Service as a public storage facility without written authorisation;
- use the Service as a general-purpose content-distribution network, public file-sharing service, or primary production filesystem;
- generate traffic or operations that unreasonably degrade the Service or impose disproportionate cost; or
- circumvent plan limits, metering, retention, device limits, or technical restrictions.
4. Security duties
Customer shall use reasonable endpoint security, maintain supported software, protect accounts with appropriate authentication, restrict administrator access, and promptly revoke compromised users or devices. Suspected compromise or unauthorised access must be reported without undue delay through the customer portal.
5. Regulated and sensitive data
Customer shall not use the Service for data subject to specialised legal or contractual controls unless Provider has expressly agreed in writing to the required terms and safeguards. Availability of encryption or other security features does not by itself establish compliance with HIPAA, PCI DSS, export controls, professional-secrecy duties, or any other regime.
6. Enforcement
Provider may investigate suspected violations, preserve relevant evidence, limit operations, quarantine affected data, suspend devices or accounts, remove unlawful material where legally permitted, or terminate Service. Action may be immediate and without prior notice where necessary to prevent harm, protect systems or third parties, or comply with law. Fees are not refundable for suspension or termination caused by an AUP violation.
7. Cooperation and reporting
Customer shall reasonably cooperate with an investigation and remedial action. Provider may report apparent unlawful conduct and disclose information to competent authorities or affected parties where required or permitted by law. Knowingly false or abusive reports are prohibited.
8. Changes and reports
Provider may amend this AUP to address legal, security, or operational developments. Material changes will be notified as required by law. Report suspected abuse through the authenticated support facilities at maxbackups.cenmax.in.
